Overtime Rules by State

Overtime rules vary depending on the state where you work. Your pay is calculated based on the laws of the state where each shift segment takes place.

California

California has state-specific overtime rules that go beyond federal requirements:

  • Daily overtime: Hours worked beyond 8 in a single workday are paid at 1.5x your regular rate.
  • Daily double time: Hours worked beyond 12 in a single workday are paid at 2x your regular rate.
  • Weekly overtime: Hours worked beyond 40 in a workweek are paid at 1.5x your regular rate.
  • 7th consecutive day: If you work 7 consecutive days in a workweek, all hours on the 7th day are overtime (1.5x), and hours beyond 8 on that day are double time (2x).

Arizona, Texas & Other Federal-Only States

Arizona, Texas, and many other states follow federal overtime rules only. There is no state-level daily overtime:

  • Weekly overtime: Hours worked beyond 40 in a workweek are paid at 1.5x your regular rate.
  • No daily overtime: There is no overtime threshold based on hours worked in a single day.
  • No double time: The 2x pay rate does not apply under federal rules.
  • No 7th consecutive day rule: Working 7 days in a row does not trigger additional overtime under federal law.

Cross-State Work

If you work across state lines during a shift or workweek, the overtime rules of the state where each segment of work takes place apply to that segment. For example:

  • Hours worked while clocked in or out in California are subject to California overtime rules.
  • Hours worked entirely in Arizona or Texas follow federal rules only.
  • All hours worked count toward the 40-hour weekly overtime threshold regardless of state.
  • The 7th consecutive day rule applies if the 7th day is worked in California, even if some of the prior 6 days were in other states. If the 7th day is not in California, the rule does not apply.
